Press Statement: Response to MP’s call for halt in Balik Pulau projects

I refer to Balik Pulau MP Yusmadi Yusoff’s comments, published in FreeMalaysiaToday.com yesterday, calling for a blanket halt on all development projects in his constituency.
The state government cannot arbitrarily halt projects that have been approved unless they are found to violate the conditions set on its approval. Stop-work orders can be issued in the event projects do not comply with the many conditions such projects need to adhere to. These conditions include environmental, traffic, as well as social impact concerns. In this regard, I welcome MP Yusmadi’s concern for Balik Pulau and await his official input on the matter.
Indeed, the State Government refers project applications to local representatives for their comments before approvals are decided upon. We have rejected applications before, especially those involving hill slope development and active agricultural land. As for squatters, ‘resettlement’ is also a condition of approval.
The Penang State Government reiterates its commitment to be a people-friendly government that practices good governance. We welcome constructive ideas from all quarters for the holistic and sustainable building of a better tomorrow.

MEMORANDUM TO PENANG CHIEF POLICE OFFICER
29 JUNE 2011
ARBITRARY ARRESTS AND FALSE ACCUSATIONS AGAINST PSM ACTIVISTS
We the undersigned civil society groups in Penang strongly condemn the arrest of 30 PSM activists under Section 122 of the Penal Code 122 for “waging wars against the Yang DiPertuan Agong” that carries life imprisonment for a term not exceeding 20 years.
The PSM activists, including Sungai Siput MP D Jeyakumar were halted by police at the Sungai Dua toll plaza, when they were on their way to attend a ceramah dubbed ‘Udahlah tu, bersaralah BN’ at Bayan Baru. The police who found PRM leaflets and newsletter and other paraphemalia including T-Shirts bearing the images of former Communist fighters Chin Peng, Suriani Abdullah and Rashid Maidin, came to the conclusion that the group was trying to revive the communist ideology and therefore they should be investigated for “waging war against the Yang di-Pertuan Agong”.
This is not the only example of abuse of power by police. Basic necessities in the lockup such as adequate washrooms, water etc do not meet basic standards of living. Human rights violation cases taken place during their detention, when a woman who suffered from diabetes was given a cup of sweet water when she asked for warm water, another one was punched and kicked by the police, while all of them were denied access to lawyers. We have also learned that the 7 detainees held at the Penang Police Headquarters are put into solitary confinement and we find this extraordinary treatment very worrying. We have no information on the condition of the other 24 detainees currently held at Kepala Batas. The extreme accusations by the police on peace-loving citizens of this country defies common sense and so we urge the police to open up their purported investigations and conduct for immediate scrutiny. The police cannot simply accuse citizens of a crime and proceed to mistreat them under detention. We reiterate the need for lawyers to be allowed routine visits to ensure the well being of people in police custody.
We are deeply shocked and disturbed by this blatant disregard to the fundamental of human rights in Malaysia as enshrined in Federal Constitution. It is a case of abuse of power by the government machinery, including the police force, the failure of police-prosecutor-judiciary collusion to protect fundamental human rights.
The arrest further illustrates the fear of the ruling party of the people power, when BERSIH 2.0 rally is just around the corner, while police has been used as a political tool by the ruling party to hit their objective. This is clearly seen when a nationwide police crackdown on pre-Bersih activities and reported ban on political events.
We are very much concerned over the continuous act of obtaining blanket unilateral restraining orders against the general public as a means to crack down any activity opposing the ruling party. We are of the view that the act of obtaining such restraining orders is a serious abuse of legal process. Once again, police is the accomplice in this matter.
We, in the light of these incidences, urge the CPO to
1. Release all the detainees immediately!
The arrest is truly an unlawful act and disregard of the Constitutional Rights. Police should release all the detainees immediately and apologise to the public.
2. Take action on police who misuse of power
Any ill-treatment received by the detainees during their detention is not tolerable. Police should be at the people’s side and not the rulling party’s. It is serious when all the injuries, physically or mentally, come from the police because it means the police themselves are the criminals.
3. Stop being used as a political tool by using arbitrary restraining orders against peaceful citizens.
Police has been used as a political tool to arrest citizens exercising their rights. Such orders are made based solely on one party’s prejudice that undermines the subjected parties’ right to be heard.
4. Respect freedom of expression and freedom of assembly.
Police should stop disrupting peaceful assemblies and any other activities, either BERSIH 2.0 or leafleting. Freedom of expression and freedom of assembly is enshrined in our Federal Constitution. Respect these freedom means respect your own freedom and vice versa.
5. Stop arresting and harassing activists.
Activists have always been exposed to arrest and detention without trial because most of their demands are away from the benefit of the ruling party. Therefore, in most time police will get order from the ruling party to crackdown their activities. Please stop arresting and harassing the activists for the sake of the society.
6. Grant access to lawyers and family members to visit
We are extremely concerned that conditions of police lockups do not meet basic living standards. Police have also been reported to be mistreating (including beating up) detainees. We demand that lawyers and family members be allowed to visit detainees immediately to ensure their well being under custody.
7. Concentrate more on catching criminals
Instead of getting their head into disrupting activities which threaten the position of ruling party, police should making more effort in catching criminals.

Press Statement by YB Dr Xavier Jayakumar, Selangor State EXCO and State Assemblyman for Seri Andalas
COMMITTEE FOR NON-MUSLIM AFFAIRS – SELANGOR & PENANG
I salute the move taken by YAB Lim Guan Eng and the Penang state government in forming an official portfolio for non-muslim affairs, it is an effort that is to be commended.
The central aim and objectives of the Committee for non-muslim affairs is to promote greater inter-faith understanding and build strong working relationships between all non-muslim religious bodies and the state governments.
For example, Selangor’s non-muslim committee is jointly chaired by myself, YB Teresa Kok and YB Ronnie Liew, along with four other ADUNs, 7 representatives of the main non-muslim religious bodies and various other government department representatives including reps from District Offices, JAIS, JKR, JPS and PTG.
The Barisan National government should welcome the initiatives taken by the Penang state government and not feel threatened. Furthermore, it was only 3 days ago that the “PM hailed the government’s interfaith sub-committee as key in creating a common understanding and having constructive dialogue among the different religious groups in the country.”(Malaysian Insider, 14, Feb 2011)
In light of his comments it is highly regrettable and irresponsible of the Government to allow the
Utusan to make such a racially provoking statement against the non-muslim portfolio established by a Pakatan Rakyat state.
It is the responsibility of everyone to promote greater comprehension and tolerance of all the different faiths in Malaysia. We must not resort to racial and religious politics in order to fulfill political aims.

2nd Penang Bridge completion in 2013
The 2nd Penang Bridge in Penang connecting Batu Maung in the south-eastern part of the Penang Island to Batu Kawan on the mainland will supercede the existing bridge in being the longest in the country and South-East Asia when completed. Its total length of 23.5km will take approximately 20 minutes to travel across at 80km per hour. In the latest update, the bridge is scheduled for completion in September 2013, after numerous delays.
Bukit Bendera MP Liew Chin Tong raised questions at the Dewan Rakyat pertaining to the cost of the second bridge which now stands at RM4.5 billion. It was formerly RM4.3 billion in 2008 when the price of oil was at its peak. He further asked for clarifications for an amount of RM20 million which was being allocated for ceremonial duties and RM63.51 million which was for overhead and support expenses. The Prime Minister, Najib Razak in his reply stated that the cost of the bridge had not risen but did not elaborate on the RM83.51 million. He also confirmed that the said cost includes the construction of the casting yard by CHEC Construction (M) Sdn. Bhd. And UEM Builders Bhd.
In a press conference held at the CHEC office in Batu Maung, CM Lim Guan Eng revealed that the 2nd Penang Bridge was now 25% completed. The substructure of the bridge,at RM2.2billion is managed by CHEC Construction, a China-based company, while its superstructure, at RM1.5 billion by UEM Builders. Three other companies were awarded to build the highways. Cergas Murni for the Batu Maung area at RM67 million; IJM Corp Bhd for the Batu Kawan area at RM350 million; and HRA Teguh Sdn. Bhd. for the roads joining the North-South Highway at RM152 million.
An impact study on the bridge showed that it could withstand collision of up to 1 Mega Newton; and has a seismic loading of up to 8.0 on the Richter scale. The 2nd Penang Bridge has a lifespan of 120 years.
Commenting on the toll increase in 2013, CM Lim said that Penang will oppose the hike and that there will be an anti-RM9.40 Penang Bridge Toll Rate meeting. This will be a 34% increase from the current RM7.00. Drawing parallels to Najib’s Persian cat which he recently purchased to which he asked for suggestions for names, Lim was peeved that the PM did not consult the 1.5million residents in Penang Island for the hike in toll rates.
