In support of the family of the late Cheah Chin Lee (died in police custody):
Police Yet to Inform Courts of Chin Lee’s Death

It is now close to two months after Cheah Chin Lee died in the Police’s custody. I am here today with Chin Lee’s family members who are still waiting for answers. Sadly, despite numerous promises made to the family, the Police have been unable to show any progress for the family to have faith in their efforts.

The family’s lawyer wrote to the Magistrates Court of George Town, Penang to enquire about initiating inquest proceedings and received a reply from the court registrar on 25 September, 2012 saying that the courts have not received a Sudden Death Report regarding Chin Lee’s death on 13 August.

Section 334 of the Criminal Procedure Code requires, “when any person dies while in the custody of the police or in a mental hospital or prison, the officer who had the custody of that person or was in charge of that mental hospital or prison, as the case may be, shall immediately give intimation of such death to the nearest Magistrate, and the Magistrate or some other Magistrate shall, in the case of a death in the custody of the police, and in other cases may, if he thinks expedient, hold an inquiry into the cause of death.”

I would like to emphasise that it is the statutory duty of the Police to inform the courts of a death of a person in their care and that this is required to be done immediately. It is now close to two months since Chin Lee’s death and I would like to ask if the Police are deliberately delaying the matter. What excuses do the police have for the family this time? If the police cannot even do something as simple as following a statutory procedure, how can the police claim to be conducting an “independent” investigation over the death of a person who was in their care?

I hereby urge the Penang CPO Abd Rahim Hanafi to take responsibility and explain the delay over this matter. I do not expect more empty promises to be made, but instead in the soonest possible submit the Sudden Death Report to the Magistrates Court as required under S334 of the CPC. The Police must not be seen to hinder the family’s quest for the truth behind Chin Lee’s death.

Dakwaan SPNB Bahawa Kerajaan PR Sengaja Ubah Syarat
Untuk Lengah CF Adalah Tidak Berasas.

Syarikat Perumahan Negara Berhad (SPNB) mendakwa bahawa Kerajaan PR sengaja ubah syarat untuk lengah CF adalah tidak berasas.

Saya telah mengarah Majlis Perbandaran Pulau Pinang (MPPP) dan Majlis Perbandaran Seberang Perai (MPSP) untuk menyiasat dakwaan tersebut dan mendapati ianya merupakan tohmahan sahaja.
MPSP telah melaporkan bahawa ia tidak mengenakan sebarang syarat tambahan yang baru semasa CF dipohon. Permohonan diproses mengikut syarat yang telah diluluskan dalam Pelan Bangunan.
Pada masa kini, MPSP sedang memproses permohonan CF daripada SPNB untuk 1 blok rumah pangsa kos rendah 4 tingkat (82 unit) di Taman Sejahtera Indah, Telok Ayer Tawar dan permohonan tersebut diterima pada 29 Jun 2011.

MPPP perlu melaporkan bahawa projek rumah pangsa kos sederhana rendah 27 tingkat (404 unit) Vista Mutiara di Jelutong baru mengemukakan permohonan CF pada 16 Jun 2011. Walau bagaimanapun dua syarat didapati belum dipatuhi iaitu penyerahan tanah tapak penjaja kepada MPPP dan syarat penamaan jalan.

Pada 14 Julai pemaju mengemukakan permohonan kali kedua dan jika semua syarat dipatuhi, CF dijangka boleh dikeluarkan dalam masa yang terdekat.
SPNB seharusnya menunjukkan bukti bahawa PBT sengaja ubah syarat untuk melengah CF.
Pada lazimnya CF tidak dapat dikeluarkan kerana kegagalan pemaju memenuhi syarat syarat.
Kerajaan Negeri Pulau Pinang mengalu-alukan pihak pemaju sama ada dari sektor swasta dan awam untuk memajukan projek perumahan mampu milik.
PBT diarahkan untuk memudahkan proses permohonan supaya matlamat menyediakan rumah mampu milik boleh dicapai.

Lebih baik bagi SPNB merunding dengan PBT untuk menangani masalah teknikal daripada membuat tuduhan yang berasas di surat khabar.

I refer to Balik Pulau MP Yusmadi Yusoff’s comments, published in FreeMalaysiaToday.com yesterday, calling for a blanket halt on all development projects in his constituency.
The state government cannot arbitrarily halt projects that have been approved unless they are found to violate the conditions set on its approval. Stop-work orders can be issued in the event projects do not comply with the many conditions such projects need to adhere to. These conditions include environmental, traffic, as well as social impact concerns. In this regard, I welcome MP Yusmadi’s concern for Balik Pulau and await his official input on the matter.
Indeed, the State Government refers project applications to local representatives for their comments before approvals are decided upon. We have rejected applications before, especially those involving hill slope development and active agricultural land. As for squatters, ‘resettlement’ is also a condition of approval.

The Penang State Government reiterates its commitment to be a people-friendly government that practices good governance. We welcome constructive ideas from all quarters for the holistic and sustainable building of a better tomorrow.

Isu Penswastaan Sisa Pepejal Negeri Pulau Pinang

Kerajaan Negeri Pulau Pinang baru-baru ini menerima surat daripada Datuk Ahmad bin Haji Kabit, Ketua Setiausaha Kementerian Perumahan dan Kerajaan Tempatan bertarikh 8hb Julai 2011 mengesahkan bahawa Kerajaan Pusat telah memberi kelulusan kepada Negeri Pulau Pinang dan Selangor supaya kecualikan daripada penguatkuasaan Akta Pengurusan Sisa Pepejal dan Pembersihan Awam 2007 yang akan dikuatkuasa mulai 1hb September 2011.

Perkara ini juga mendapat mengesahan daripada jawapan Menteri Perumahan dan Kerajaan Tempatan kepada YAB Lim Guan Eng, merangkap Ahli Dewan Rakyat Bagan di dalam Dewan Rakyat pada 28hb Jun 2011.

Ini bermakna, Kerajaan Negeri telah berjaya menolak penerimaan penswastaan pengurusan sisa pepejal dan pembersihan awam di bawah Akta Pengurusan Sisa Pepejal dan Pembersihan Awam 2007. Oleh yang demikian, semua tanggungjawab berhubung dengan pengurusan sisa pepejal dan pembersihan awam akan dipikul oleh Pihak Berkuasa Tempatan Pulau Pinang. Kos-kos pengurusan sisa pepejal dan pembersihan awam juga akan ditanggung oleh Kerajaan Negeri dan PBT Pulau Pinang tanpa bantuan daripada Kerajaan Persekutuan.

Dalam hal ini, isu permohonan lesen di bawah Akta 672 juga tidak timbul dan pihak operator perkhidmatan pengurusan sisa pepejal dan pembersihan awam di Negeri Pulau Pinang tidak perlu membuat permohonan lesen kepada Jabatan Pengurusan Sisa Pepejal Negara.

Walaubagaimanapun, PBT Pulau Pinang sudi mematuhi KPI yang ditetapkan oleh Kerajaan Persekutuan supaya dapat melaksanakan kerja-kerja pengurusan sisa pepejal dan pembersihan awam dengan baik.

I view with great concern the rising state of repression in our country. With regards to Saturday’s (Jul 9, 2011) Bersih rally in the nation’s capital city of Kuala Lumpur, it is impossible to ignore the violent actions of the Royal Malaysian Police in acting against peaceful protesters. Prime Minister Dato’ Sri Najib Tun Razak’s comments today that “Police had used minimum force and there was no actual physical contact” is an outright lie, which is contradicted by the abundant availability of photographs and video clips documenting the blatant opposite of his imagined claims.

PM Najib’s dishonest assessment of Saturday’s events is propped up by a wall of silence from his approving coalition partners, who – unless they speak up strongly and immediately – collectively sanction the use of chemical weapons against unarmed Malaysians. This is particularly agonising given the fact that one man has died as a result of this violence. Further denials by the Police that they “did not lay a finger” on the late Baharuddin Ahmad ring hollow especially as they also unabashedly denied attacking Tung Shin Hospital on Jalan Pudu when protesters were forced to seek refuge from the choking and stinging effects of inhaling 2-chlorobenzalmalononitrile (a.k.a. CS gas). Instead of issuing mere denials, Home Affairs Minister Dato’ Seri Hishamuddin Tun Hussein and IGP Tan Sri Ismail Omar must confront the hard evidence that their men fired numerous volleys of tear cas canisters as well as sprayed chemical-laced water into hospital grounds – where protesters were trapped without any safe dispersal route available – thereby creating havoc and risking the wellbeing of patients in the hospital. This rabid and irresponsible action by the Police is uncalled for and I demand Minister Hishamuddin and IGP Ismail be held accountable.

I need to voice concern, too, with the Police’s violent handling of Bersih 2 and Pakatan leaders. Reportedly, Parliamentary Opposition Leader Dato’ Seri Anwar Ibrahim sustained injuries to his head and knee and had to be hospitalised as a precaution. His bodyguard was less fortunate, taking a direct hit to the face from a tear gas canister and required surgery to repair damage to his face. The deliberate firing of a dangerous projectile into the crowd or aiming it at particular persons is a criminal act. I understand the Police have a role to play in dispersing a crowd that has turned rowdy or violent. However, the act of firing canisters at peaceful people directly is criminally motivated, hence utterly disparages Malaysia’s image as a democratic nation.

The immediate step PM Najib Razak needs to take is to recognise the sheer amount of discontentment with his government’s continued lack of commitment for free and fair elections. If it is true, as it is reported, that he isn’t “afraid” of fair elections, it is time to take Bersih’s demands seriously and reform our electoral system. As for Home Affairs Minister Hishamuddin Hussein, he has to take full responsibility over Police brutality, the usage of chemical weapons in enclosed areas and a hospital, the city-wide lock down, the massive network of road blocks, as well as intimidation against peaceful rally-goers. I also demand the release of the six PSM activists, including my colleague in Parliament Dr Jeyakumar Devaraj, who are still detained under the Emergency Ordinance. As the detention order was justified on belief that the PSM six intend to participate in the Bersih rally, I call upon the Police to release them immediately since July 9 is already a matter of history and it is no longer humanly possible for them to travel back to that date.

Saturday’s Bersih rally, which saw tens of thousands of Malaysians defying the government clampdown and rise up to voice their collective concern for free and fair elections, is a clear indication of the rakyat’s ability to join hands across the imagined boundaries of ethnicity and religion – boundaries which have been used by UMNO-BN to divide and rule this country for so long. Also encouraging is the fact that Malaysians and their friends from all over the world gathered in various cities globally to lend support for Bersih’s cause. This is patriotism at the highest level. There is reason for all Malaysians to have hope for genuine multiracial politics in this country instead of suffering under the continued ethnocracy of UMNO-BN. And for that to happen, the rakyat must remember that, despite all odds, the 9th of July was the peoples’ victorious celebration of democracy in Malaysia.

Sukacita dimaklumkan bahawa kerajaan negeri akan menganjurkan Forum Perundingan Kerajaan Tempatan yang kedua bagi tahun 2011 pada 4hb Julai 2011.

Forum ini akan diadakan di Dewan Bosch, Tingkat 1, Kompleks Mesyuarat Penyayang, Jalan Utama dan akan bermula pada jam 9.00 pagi hingga 12.30 tengahari.

Forum ini akan dipengerusikan oleh YB Chow Kon Yeow, Pengerusi Jawatankuasa MMK Kerajaan Tempatan dan Pengurusan Lalu Lintas.

Isu yang akan dibangkit dan dibincang pada forum kali ini adalah isu perumahan. Pembentangan termasuk Perumahan Mampu Milik bagi rakyat Pulau Pinang dan Pergerakan harga rumah di Pulau Pinang.

Kerajaan Negeri Pulau Pinang mengalu-alukan kehadiran stakeholders dan pihak yang berminat untuk mengambil bahagian dalam forum kali ini supaya dapat bersama-sama menyumbangkan idea-idea demi mempertingkatkan pembangunan sosio-ekonomi negeri Pulau Pinang.

YB Chow Kon Yeow, Pengerusi Jawatankuasa Kerajaan Tempatan dan Pengurusan Lalu Lintas telah mengarahkan YDP Majlis Perbandaran Pulau Pinang membuat laporan polis terhadap kes kuda yang mencederakan seorang budak perempuan di Pantai Batu Ferringhi.

Kejadian ini telah mengakibatkan orang awam tercedera. Oleh itu, kami berharap pihak polis dapat menyiasat kes ini dan mendakwa pengusaha yang terlibat.

MPPP telah menghantar pasukan penguatkuasaan untuk meronda di sekitar Pantai Batu Ferringhi setiap hari dari 8 pagi hingga 8 malam supaya dapat membanteras aktiviti kuda di pantai. Malangnya masih terdapat pengusaha yang keluar mencari makan dan telah mencederakan orang awam.

Oleh yang demikian, kerajaan negeri berharap pihak polis dapat mengcampur tangan untuk menyiasat kejadian ini serta mendakwa pengusaha terbabit.

Laporan “Traumatising Sight” oleh Akhbar Star Metro pada 25 Mei 2011

Saya telah menerima laporan daripada MPPP berkenaan dengan berita “Traumatising Sight” yang dipaparkan oleh Akhbar Star Metro pada 25 Mei 2011 seperti dilampirkan:

1. Merujuk kepada tajuk berita surat khabar STAR Metro pada 25.5.2011.

2. MPPP mempunyai sebuah pasukan Pengawalan Anjing untuk mengawal seluruh Pulau Pinang. Unit ini bertanggungjawab untuk menangkap anjing liar, anjing tanpa lesen, anjing yang mengejar orang awam, dan anjing yang mengancam keselamatan orang awam berdasarkan kebanyakan aduan yang diterima oleh MPPP setiap hari.

3. Seperti yang diarahkan Unit ini tidak dibenarkan menembak anjing-anjing yang telah ditangkap di hadapan orang awam. Anjing yang ditangkap akan dibawa balik ke Pejabat MPPP untuk dimusnah. Anjing-anjing yang tidak dapat ditangkap yang berada di kawasan lapang seperti di tepi pantai, kawasan bukit hanya akan ditembak menggunakan senjata “shot gun” selepas memastikan kawasan tersebut selamat. Penembak kami tidak pernah menembak di kawasan perumahan seperti yang dilaporkan dalam akhbar berkenaan kerana peluru ‘shot gun’ mengandungi antara 150-155 kacang-kacang timah dan kacang-kacang ini boleh melantun balik dan berbahaya kepada orang awam dan harta benda. Anjing yang ditangkap akan dimusnahkan menggunakan “humane stunner” yang diimport dari England. Senjata ini digunakan untuk memusnah anjing tanpa menyiksa haiwan tersebut, dimana senjata ini menggunakan peluru kosong yang terus menembusi sistem saraf otak haiwan tersebut yang menyebabkan haiwan mati dengan serta-merta.

4. Berdasarkan gambar foto yang disiarkan dalam akhbar berkenaan, MPPP ingin menegaskan bahawa gambar foto itu diambil sekitar tahun 2006 semasa operasi yang dianjur oleh SPCA Pulau Pinang yang turut dihadiri oleh UK Animal Solution yang dianggotai dengan pasukan penangkap anjing yang membuat demonstrasi penggunaan kaedah jaring untuk menangkap anjing. Kaedah yang ditunjukkan adalah oleh UK Solution. Demonstrasi ini turut dihadiri oleh banyak media masa. UK Animal Solution mengakui kaedah penangkapan anjing menggunakan jaring didapati tidak sesuai kerana berat dan tidak berkesan dan sebaliknya mengesahkan, kaedah yang dilaksanakan oleh MPPP adalah lebih sesuai. Kaedah inilah yang digunakan oleh MPPP sehingga sekarang. Selepas demonstrasi, Pasukan UK Animal Solution menyokong dan mengakui bahawa kaedah Majlis menjalankan operasi penangkapan dan pemusnahan anjing adalah yang terbaik.

5. Gambar foto yang ditunjukkan dalam surat khabar The Star pada 25.5.2011 adalah dari gambar fail yang diadakan demo dalam tahun 2006 dan MPPP menyangkal sepenuhnya kenyataan ini. Perkara ini boleh disahkan dengan pihak SPCA sendiri. Untuk makluman, kakitangan yang memakai T-shirt hijau adalah kakitangan dari UK Animal Solution.

Kenyataan Media Mengenai Aduan Terhadap “Corrupt Practices Of MPPP Officers & Former Councillor” oleh Dedah Korupsi (Pro Bono Publico)

Berkenaan dengan email daripada “Dedah Korupsi” oleh Pro Bono Publico bertarikh 6 April 2011 berkenaan dengan “Corrupt Practices Of MPPP Officers & Former Councillor”, siasatan telah dijalankan oleh MPPP.

Tanah yang dimaksudkan oleh pengadu ialah Lot 13180, Mukim 12, Persiaran Mahsuri 1, Taman Sunway Tunas. Tanah ini diserahkan oleh pemaju Tetuan Sunway Tunas Sdn. Bhd. dengan perjanjian namaan RM1.00 kepada Majlis sebagai tapak penjaja. Tanah ini telah didaftarkan di bawah pemilikan MPPP pada 26 September 2002.

Tanah ini diserahkan kepada MPPP sebagai tapak penjaja dalam keadaan tapak kosong yang berlantaikan konkrit dan disediakan juga tempat basuhan. Tapak penjaja ini di bawah pengurusan Bahagian Pelesenan sebagai jabatan yang bertanggungjawab atas pengurusan pasar dan kompleks penjaja.

MPPP telah menerima satu permohonan daripada Tetuan Sunway Sdn. Bhd. pada 21 Mac 2011 untuk membeli semula tanah ini tetapi MPPP telah menolak disebabkan tanah ini adalah untuk tapak penjaja. Pada ketika ini, tiada sebarang struktur yang dibina di atas tapak tersebut dan MPPP sekarang dalam proses untuk memagar tapak tersebut. MPPP belum ada sebarang perancangan untuk membina gerai-gerai penjaja.

MPPP tidak mengetahui tentang penglibatan bekas Ahli Majlis yang dimaksudkan dalam email tersebut. MPPP juga menafikan tuduhan pegawai Jabatan Penilaian dan Pengurusan Harta yang ”corrupt” kerana MPPP telah menolak permohonan ini.

This morning I have directed the President of the Penang Island Municipal Council Hajah Patahiyah Ismail and officials to speed up restructuring activities in Batu Feringghi.

The MPPP President will be meeting water sports operators this Friday to work out solutions on the zoning proposal in Batu Feringghi.

Meanwhile, the MPPP will continue to enforce the ban on horse-riding, quadbike riding and water sport activities.

The ban will allow the MPPP to engage with all stakeholders, work on the installation of safety buoys and nettings and the licensing of beach operators.

The MPPP has been able to reduce horse-riding and quadbike activities since the ban took effect last December.

The gazebos to relocate foot reflexology operators are near completion and traders will be issued licenses after the Chinese New Year holidays.
